Downloading, installing, or accessing the App means you accept these Terms and our Privacy Policy. Questions about the App or these Terms can be sent using the details in the Contact Us section below. If you do not accept these Terms, please stop using the App straight away.
General
The App is for personal, non-commercial use only. You may not use it for business purposes, or for any illegal or unauthorised activity. When using the App, you must follow all Applicable Laws, including Portuguese law and any international or local laws that apply where you live.
You agree to use the App in line with Applicable Laws and these Terms. Without limiting that duty, you agree that you will not:
- use the App unlawfully, or in a way that promotes or encourages illegal activity (including copyright infringement); or
- try to access the App, or any related networks, servers, or systems, without permission; or
- modify, adapt, translate, reverse engineer, reformat, or frame any part of the App, except where these Terms or the law expressly allow it.
Content
Copyright in everything on, in, or available through the App — including information, data, text, music, audio, photos, graphics, video, messages, how that material is selected and arranged, and all source code, software, and other works (together, the “Material”) — belongs to Manna Games, its group companies, or their licensors. All rights are reserved. You may not copy, edit, alter, reproduce, publish, display, distribute, store, transmit, commercially exploit, or otherwise use the Material in any form without Manna Games’s prior permission.
Trademarks, service marks, and logos (“Trade Marks”) appearing in the App belong to Manna Games, its group companies, or third-party partners. You may not use, copy, edit, alter, reproduce, publish, display, distribute, store, transmit, commercially exploit, or otherwise use those Trade Marks without prior written consent from Manna Games, the relevant group company, or the relevant partner.
Payment Processing
In-app purchases and related payment processing are handled by Apple, Inc. and/or Google, Inc. (together, the “App Stores”) and are governed by the App Stores’ own terms. By accepting these Terms or continuing to use the App as a paying user, you also agree to those App Store terms.
Manna Games’s Rights & Responsibilities
We do not promise that the App will always be available, uninterrupted, timely, secure, or free from bugs, viruses, errors, or omissions.
For example, the App may be unavailable for maintenance or technical reasons. We may also change, suspend, or stop offering parts of the App (or the App as a whole) without advance notice.
We are not responsible for third-party content hosted or shown in the App, including third-party games or advertising.
We are not liable for loss, damage, or inconvenience you suffer because the App is temporarily or permanently unavailable.
Subject to the rest of these Terms, we (and any third-party content provider or their agents) are not responsible for:
- temporary, intermittent, or permanent loss of connection;
- damage to your device or loss of data (including from viruses or other malicious software), except where this results from our failure to use reasonable care and skill;
- loss, damage, or inconvenience caused by another user’s actions;
- loss or damage arising from our failure to comply with these Terms where neither of us could reasonably have anticipated it when you began using the App;
- indirect or consequential loss (including loss of revenue, salary, profit, opportunity, or reputation); and
- loss or damage where the App is unavailable, interrupted, or suspended, or where we cannot meet these Terms, because of events beyond our reasonable control (including natural disaster, accident, fire, lockout, strike or other labour dispute, civil unrest, or similar events).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud.
The App is provided “as is” and “as available.” We make no representation, warranty, or promise about the App, including statements by other users, third parties, or advertisers. We may change the App at any time. Features or promotions may differ between users, so your experience may not match someone else’s.
We take reasonable steps to keep the App free from viruses and other harmful software, but you should still use suitable anti-virus protection.
User Responsibilities
A “User” is anyone who uses our platform, whether registered or not.
Users are responsible for their own security when using our services, online and offline.
Users are solely responsible for anything they post, including messages, and must not post defamatory, offensive, or illegal material.
Users must promptly report any defamatory, offensive, or illegal material they see in the App.
Users should decide for themselves how accurate App information is. Manna Games does not guarantee that all content is complete, accurate, or current.
Users remain responsible for their own internet security while using the App.
Users must contact Manna Games at once if they believe their password has been compromised.
Until Manna Games is notified, Users remain responsible for activity carried out in their name.
Users must not use the App to bypass or cut Manna Games out of any relationship or transaction connected with the App.
Users must not promote opportunities or services of any company other than Manna Games through the App.
Users agree to follow Manna Games’s Privacy Policy.
Anyone who breaches these Terms may be blocked from the App and related services.
The App is not aimed at children. Where registration is required, you should be at least 16. If you help someone under 16 to register for or use the App, you accept full responsibility for the consequences. To the fullest extent allowed by law, neither we nor any third-party content provider (nor their agents) will be liable for any direct, indirect, incidental, special, or consequential damages arising from that use, including where negligence is alleged.
Third Party Content, Advertising and Websites
Some screens may include links to third-party websites, ads, or other third-party content. Those links are provided by third parties, not by us. We do not endorse linked third-party sites or content. Subject to applicable law, we are not responsible for what happens to you or your data when you leave our App to use third-party sites or content. Third-party sites usually have their own terms, licences, and privacy policies.
Some screens may show third-party advertising. We do not control which ads appear. If an ad is offensive or inappropriate, report it to support@repeatt.co and we will look into it.
Clicking an ad takes you to the advertiser or another external party. We are not responsible for what happens on those third-party sites or with that third-party content. Check their terms and privacy policies before you proceed.
Intellectual Property
Content and information in the App are owned or licensed by Manna Games and protected by intellectual property laws. This includes, without limitation, source and object code, trademarks, logos, graphics, photographs, videos, animations, gameplay, and text. Names, titles, logos, and designs that include “Manna Games” are owned exclusively by us.
You may not use the App or its content except as these Terms allow or as we expressly permit. You may not reverse engineer, decompile, disassemble, or otherwise modify the App.
The App may let you create a username and avatar, and may let you communicate with others and post messages, images, text, or other material (“User Content”) that others can see.
By posting or sharing User Content through the App, or by sending User Content to us, you confirm that you have the rights and approvals needed to do so, and that we may use, edit, or adapt that User Content in any media without payment or further obligation to you or anyone else. You also confirm that publishing that User Content will not cause us to infringe third-party rights or break any applicable law. Do not post anything that may infringe others’ rights. We may remove potentially infringing content without notice. You agree to compensate us for losses we suffer as a direct result of your breach of the promises in this paragraph.
Disclaimers and Limitation of Liability
Nothing in this agreement limits or excludes our liability for negligence causing death or personal injury, or for anything else that cannot legally be limited or excluded.
Before you spend money fixing an issue we may be liable for, you must give us a reasonable chance to put it right.
If you are a User, we are not liable for loss or damage caused by us or our employees or agents where:
- no legal duty of care was owed to you by us or them;
- the loss or damage was not reasonably foreseeable to both parties; or
- the loss or damage was caused by you (for example, by breaching this agreement).
If you are a User, you are liable for reasonably foreseeable loss or damage we suffer because you breach this agreement or misuse the App (subject to our duty to mitigate).
The following applies only if you are not a Consumer:
To the extent permitted by law, you and we exclude all terms not expressly set out in this agreement, whether arising by statute, common law, or otherwise. References to “us” in this clause include our employees and agents.
Our total liability of any kind (including for our own negligence) relating to the App for any one event or series of related events is limited to £100.
In no event (including for our own negligence) will we be liable for:
- economic loss (including loss of revenue, profit, contracts, business, or anticipated savings);
- loss of goodwill or reputation;
- special, indirect, or consequential loss; or
- damage to or loss of data,
even if we were told such loss was possible.
This agreement is the whole agreement between us on this subject and replaces any earlier communications or agreements. Each of us confirms that no misrepresentations were made and that neither of us relied on pre-contract statements. Liability for misrepresentation (other than fraudulent misrepresentation) about the terms of this agreement is excluded.
Changes to these Terms
If we update these Terms, the revised version applies from the stated effective date if you keep using the App or related services after that date.
Governing Law & Jurisdiction
These Terms are governed by English law. Disputes will be decided only by the courts of Israel.
If any part of these Terms is found unenforceable, the remaining parts stay in effect.
